2. Subject Matter
PhotoCount is a mobile application for iOS and Android that uses artificial intelligence to detect and count objects in photos. The app is available as a free base version. An optional subscription ("PhotoCount Supporter") is offered that enables ad-free use of the app and supports the development of new AI models.
3. Subscription & Pricing
The "PhotoCount Supporter" subscription costs €4.99 per month (including applicable taxes). Billing occurs monthly in advance.
Important: Purchases and subscriptions are processed exclusively through the respective app store (Apple App Store or Google Play Store). The purchase contract is concluded between the user and Apple Inc. or Google LLC, respectively, under their terms of service. codrio is not a party to the purchase transaction.
Prices may vary by region and platform. The price displayed in the respective store is authoritative.
4. Auto-Renewal & Cancellation
The subscription automatically renews for one month at a time unless cancelled at least 24 hours before the end of the current billing period.
Cancellation is done exclusively through the settings of the respective app store:
- iOS: Settings → Apple ID → Subscriptions → PhotoCount
- Android: Google Play Store → Subscriptions → PhotoCount
Cancellation directly with codrio is not possible and has no effect. After cancellation, the subscription remains active until the end of the paid period.
5. Right of Withdrawal
Consumers generally have a 14-day right of withdrawal. For digital content that can be used immediately after purchase, the right of withdrawal expires upon commencement of performance of the contract, provided the consumer has expressly agreed that performance begins before the expiry of the withdrawal period and has acknowledged that they lose their right of withdrawal upon such commencement.
Since the subscription is activated immediately after payment and the user consents to immediate access, the right of withdrawal expires upon subscription activation. The exact withdrawal conditions are governed by the rules of the respective app store.
6. License
By downloading the app, the user receives a limited, non-exclusive, non-transferable license for private, non-commercial use of the app. It is not permitted to copy, modify, reverse engineer, decompile, or create derivative works from the app.
7. Prohibited Use
Note: PhotoCount processes all images exclusively on the user's device. No photos are transmitted to or stored on any server.
The following is prohibited:
- Reverse engineering, decompiling, or unauthorizedly modifying the app
- Performing automated access (bots, scrapers) to the server infrastructure
- Reselling, licensing, or offering the app as part of a own product or service
- Disrupting or impairing the operation of the app or servers
- Using counting results in safety-critical applications without additional verification
8. Liability
The AI-assisted counting results provided by PhotoCount are estimates and may be inaccurate. codrio assumes no liability for the accuracy, completeness, or suitability of results for any particular purpose. Liability for damages arising from the use of inaccurate counting results is excluded, unless intentional or grossly negligent conduct is involved.
Otherwise, codrio is liable in accordance with applicable law, in particular for injury to life, body, or health, and for breach of material contractual obligations.
9. Availability
codrio strives for high availability of the app and servers but does not guarantee uninterrupted operation. Maintenance, technical disruptions, or circumstances beyond codrio's control may result in temporary limitations.
10. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
codrio is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
11. Governing Law & Jurisdiction
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction for all disputes arising from this contractual relationship is, to the extent permitted by law, Minden, Germany.
12. Amendments
codrio reserves the right to amend these Terms of Service at any time with effect for the future. Users will be notified of material changes within the app. Continued use of the app after amended terms take effect constitutes acceptance.
